UG & PG Students Can’t Be Promoted Without Exams: SC Upholding UGC Direction

New Delhi: The Supreme Court today disposed the petition challenging the guidelines issued by University Grants Commission (UGC) for conduct of final semester and said states and universities  cannot promote students without holding final year exam.

However, a Bench comprising Justices Ashok Bhushan, R Subhash Reddy and M R Shah said if any state is not in a position to conduct the exams by that date prescribed by UGC. They must approach the UGC for new dates for the same.

“The direction of the State Disaster Management Authority to pass the students on the basis of previous performance is beyond the scope of Disaster Management Act. States/UTs cannot promote final year students without holding exams,” the court said.

Earlier on July 6, UGC issued guidelines to hold final year exams of UG and PG students by September 30, which was challenged by Yuva Sena, the youth wing of Shiv Sena in the apex court.
